1. Agreement to Terms

By accessing and using the CruciRiver website (cruciriver.com) and enrolling in our public speaking courses, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our services.

These Terms constitute a legally binding agreement between you and CruciRiver regarding your use of our services.

2. Description of Services

CruciRiver provides public speaking training services, including:

  • In-person and online public speaking courses
  • Individual and group coaching sessions
  • Corporate training programs
  • Educational resources and materials
  • Assessment and feedback services
  • Workshop and seminar programs

3. Eligibility and Registration

3.1 Age Requirements

Our services are available to individuals who are:

  • 18 years of age or older, OR
  • 13-17 years of age with parental or guardian consent
  • Children under 13 are not eligible for our services

3.2 Registration Process

To enroll in our courses, you must:

  • Provide accurate and complete registration information
  • Pay required fees and deposits
  • Agree to these Terms of Service
  • Meet any specific course prerequisites

3.3 Account Responsibility

You are responsible for maintaining the confidentiality of your account information and for all activities under your account.

4. Course Enrollment and Fees

4.1 Course Fees

Course fees are clearly stated during the enrollment process. All fees are in Australian Dollars (AUD) unless otherwise specified.

4.2 Payment Terms

  • Full payment is required before course commencement unless alternative arrangements are made
  • Payment plans may be available for qualifying courses
  • Late payment fees may apply to overdue accounts
  • All prices are subject to change without notice

4.3 Enrollment Confirmation

Course enrollment is confirmed only upon receipt of full payment and completion of registration requirements.

5. Cancellation and Refund Policy

5.1 Student Cancellations

  • More than 14 days before course start: Full refund minus $50 administrative fee
  • 7-14 days before course start: 50% refund
  • Less than 7 days before course start: No refund
  • After course commencement: No refund

5.2 CruciRiver Cancellations

If we cancel a course due to insufficient enrollment or other circumstances beyond our control, you will receive a full refund or the option to transfer to another course.

5.3 Satisfaction Guarantee

We offer a 30-day satisfaction guarantee. If you are not satisfied with your course experience, contact us within 30 days for a possible refund or course transfer.

5.4 Refund Processing

Approved refunds will be processed within 10 business days to the original payment method.

6. Attendance and Participation

6.1 Attendance Requirements

  • Regular attendance is essential for course success
  • Students must attend at least 80% of scheduled sessions to receive certification
  • Make-up sessions may be available for excused absences

6.2 Participation Standards

Students are expected to:

  • Participate actively and respectfully in all activities
  • Complete assigned exercises and homework
  • Respect other students and instructors
  • Follow all course guidelines and instructions

6.3 Disruptive Behavior

We reserve the right to remove students who engage in disruptive, inappropriate, or harmful behavior without refund.

7. Intellectual Property

7.1 Course Materials

All course materials, including but not limited to:

  • Workbooks and handouts
  • Video and audio recordings
  • Presentations and slides
  • Online content and resources

Are the intellectual property of CruciRiver and are protected by copyright and other intellectual property laws.

7.2 Usage Rights

Students may use course materials for personal learning purposes only. Reproduction, distribution, or commercial use is prohibited without written permission.

7.3 Student Content

Students retain ownership of their presentations and speeches but grant CruciRiver limited rights to use excerpts for educational and promotional purposes.

8. Privacy and Confidentiality

8.1 Personal Information

Your privacy is important to us. Please review our Privacy Policy for detailed information about how we collect, use, and protect your personal information.

8.2 Course Recordings

Courses may be recorded for quality assurance and training purposes. Students will be notified of any recordings and may opt out if desired.

8.3 Confidentiality

What is shared in class stays in class. Students agree to maintain confidentiality regarding other students' personal information and experiences shared during courses.

9. Disclaimers and Limitations

9.1 Educational Nature

Our courses are educational in nature and results may vary between individuals. We cannot guarantee specific outcomes or improvements.

9.2 Professional Advice

Our courses do not constitute professional therapy, medical advice, or psychological counseling. Students with severe anxiety or other mental health concerns should consult appropriate professionals.

9.3 Limitation of Liability

CruciRiver's liability is limited to the amount paid for the specific course or service. We are not liable for indirect, incidental, or consequential damages.

9.4 Force Majeure

We are not liable for delays or failures due to circumstances beyond our control, including natural disasters, pandemics, or government regulations.

10. Technology and Online Services

10.1 Technical Requirements

For online courses, students are responsible for having appropriate technology and internet connectivity.

10.2 Platform Availability

While we strive for 100% uptime, we cannot guarantee uninterrupted access to online platforms and services.

10.3 Technical Support

Basic technical support is provided for our platforms. Advanced technical issues may require additional assistance at student's expense.

11. Modifications to Terms

We may modify these Terms at any time by posting updated terms on our website. Continued use of our services after changes constitutes acceptance of the new terms.

Material changes will be communicated to enrolled students via email or other appropriate means.

12. Termination

12.1 Termination by Student

Students may terminate their enrollment subject to our cancellation and refund policy.

12.2 Termination by CruciRiver

We may terminate a student's enrollment for:

  • Violation of these Terms
  • Non-payment of fees
  • Disruptive or inappropriate behavior
  • Failure to meet course requirements

12.3 Effect of Termination

Upon termination, access to course materials and services will cease. Refunds, if any, will be provided according to our refund policy.

13. Dispute Resolution

13.1 Internal Resolution

We encourage students to first attempt to resolve any disputes through direct communication with our team.

13.2 Mediation

If internal resolution fails, disputes may be submitted to mediation through a mutually agreed mediator.

13.3 Governing Law

These Terms are governed by the laws of Tasmania, Australia. Any legal proceedings will be conducted in Tasmanian courts.

14. General Provisions

14.1 Entire Agreement

These Terms, together with our Privacy Policy and any course-specific agreements, constitute the entire agreement between you and CruciRiver.

14.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

14.3 Waiver

Our failure to enforce any provision does not constitute a waiver of that provision or any other provision.

14.4 Assignment

Students may not assign their enrollment or rights under these Terms without our written consent.
